MyHealth Records Privacy Policy

MyHealth Records, in accordance with Alberta Health’s and Alberta Health Services’ information management requirements, maintains the confidentiality and privacy of individuals' personal and health information while collecting, using, and disclosing information in compliance with the Health Information Act and the Freedom of Information and Protection of Privacy Act. Alberta Health and Alberta Health Services support the right of individuals or their authorized representatives to access and request corrections to their personal and health information, subject to any specific restrictions in applicable legislation.

Alberta Health and Alberta Health Services will not collect, use, or disclose personal or health information in any manner that is not in accordance with the Health Information Act, the Freedom of Information and Protection of Privacy Act, or their established policies.

Alberta Health and Alberta Health Services may collect personal or health information when you voluntarily complete any online application, request form, or survey, or when you use MyHealth Records and the PHR. Information may be collected pursuant to sections 18–24 of the Health Information Act, and section 33 of the Freedom of Information and Protection of Privacy Act, as applicable.

We will use your health information and personal information as necessary to provide services and operate MyHealth Records and the PHR, including but not limited to, converting documents received from you or on your behalf to an appropriate electronic format, maintaining your account, understanding usage patterns, and enhancing product capability and performance. We will use and disclose it for no other purpose, other than in the following circumstances:

• we are required to do so by law, including by a subpoena, warrant or court order; or
• for the purpose of a court proceeding or a proceeding before a quasi-judicial body to which Alberta Health or AHS is a party.

MyHealth Records Account and Personal Health Record Privacy Policy

This section of the privacy policy only applies to the MyHealth Records Account and the Personal Health Record (“PHR”).

The MyHealth Records PHR service enables you to gather, store, edit, track and share your health information in one easy to locate online location. In order to utilize the MyHealth Records PHR service, you must first register as a MyHealth Records Account user. The information you provide to register for a MyHealth Records Account is subject to this Privacy Policy. Please refer to the MyHealth Records User Agreement for terms and conditions of utilizing the MyHealth Records Account and PHR service.

Alberta Health and Alberta Health Services may collect your personal health information when you voluntarily enter information into personal health records within your PHR account and/or as you use the MyHealth Records Account and PHR service. The information is collected as part of the PHR service we are offering. PHR will collect information voluntarily entered by the user, and may collect additional information about how the MyHealth Records Account and PHR service are used from other sources where the user has consented. Information is collected pursuant to Part 3 of the Health Information Act and section 33 of the Freedom of Information and Protection of Privacy Act, as applicable.

If you choose to register and create a personal health record within your MyHealth Records Account, your health information may be used by Alberta Health and Alberta Health Services for the management, operation, and continuity of your MyHealth Records Account and personal health records within it. Whenever possible we will only use non-identifying aggregate information for the management and operation of the PHR service.

The Health Information Act and other legislation governing Alberta Health and/or Alberta Health Services may permit discretionary disclosure of your health information without your consent. However, notwithstanding this, Alberta Health and Alberta Health Services expressly agree not to disclose any personal information or health information that you have entered or caused to be entered into your PHR to any third party without your prior written consent or authorization, unless we are required to do so by law, including by court order or subpoena.
